Terms of Service

These Terms of Service ("Terms") govern access to and use of the IBretake platform, website, and related services made available by IBretake ("IBretake", "we", "us", or "our").

By creating an account, submitting a retake search request, registering as a school coordinator, making a payment, or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.

If you are under 18 years old, your parent or legal guardian must review and accept these Terms on your behalf, and by using the Platform you confirm that such consent has been obtained.

Refund policy summary.

  • Students can request a full refund after 5 working days from submitting a Retake Search Request if no School has accepted the request yet.
  • If no School accepts within 14 days, IBretake starts the full refund process automatically.
  • Once a School accepts, the placement is considered successful; the Search Package Price is no longer refundable except where mandatory law requires otherwise.
  • Any School Fee refund depends on the relevant School's own policy, deadlines, costs already incurred, and applicable law.
  • Refund or withdrawal requests must be sent to [email protected] with enough information to identify the Account and case number.

1. Definitions

In these Terms:

  • "Account" means a registered user account on the Platform.
  • "Retake Search Request" means a paid request submitted by a Student after selecting countries, subjects, candidate location or radius, and checkout details.
  • "Accepted Placement" means a Retake Search Request that a School has accepted for one or more requested subjects and that IBretake has recorded as accepted on the Platform. Where the Platform requires a signed school agreement or admin approval, the placement is treated as successful only after those steps are completed and recorded.
  • "Search Package Price" means the amount displayed to the Student before checkout for activating a Retake Search Request.
  • "School Fee" means any amount separately charged by a School for hosting, registration, invigilation, administration, or related examination services.
  • "IB Policies" means the rules, deadlines, procedures, eligibility requirements, and policies imposed by the International Baccalaureate Organization or by a School in relation to IB retake registration and hosting.
  • "Platform" means the website currently operated under ibretake.com and any associated applications, dashboards, communication tools, content, and services.
  • "School" means an IB World School or other educational institution listed or onboarded on the Platform.
  • "Services" means the search, intermediary, communication, request routing, dashboard, payment, refund, and related administrative services provided by IBretake through the Platform.
  • "Student" means a user seeking to register for, arrange, or explore IB examination retake hosting through a School.
  • "User" means any person or entity using the Platform, including Students, Schools, parents, guardians, and visitors.

2. Nature of the service

IBretake is an online intermediary platform that lets Students submit one paid IB retake search request and lets eligible School coordinators in the selected countries or search zone review that request.

IBretake is not a school, not an exam centre, not the International Baccalaureate Organization, and not a representative or agent of the IBO. IBretake is not affiliated with, endorsed by, or sponsored by the International Baccalaureate Organization.

IBretake does not itself administer examinations, determine eligibility, issue grades, award diplomas, arrange new IA or coursework supervision, or guarantee access to any examination session. Any examination hosting, registration acceptance, subject availability, invigilation, or exam-day arrangement is ultimately determined by the relevant School and applicable IB Policies.

3. Eligibility

By using the Platform as a Student, you represent and warrant that:

  • You are a former IB Diploma Programme or IB course candidate, or you are otherwise eligible under applicable IB Policies to pursue retake registration.
  • You are responsible for independently verifying your own eligibility, including any deadline, subject, or retake-window requirements.
  • All information you submit to the Platform is true, complete, accurate, and up to date.
  • If you are under 18, you have valid parental or guardian authorization.

IBretake may request supporting information or documents, including prior exam history, identity information, contact details, selected subjects, candidate location, and search preferences, in order to process a Retake Search Request.

4. Accounts

You may be required to create an Account to use some or all Platform features. You must keep your login credentials secure and are responsible for all activity carried out through your Account.

You may not create an Account using false details, impersonate another person, or maintain multiple Accounts for abusive or deceptive purposes. We may suspend, restrict, or terminate any Account that violates these Terms or presents legal, compliance, fraud, or operational risk.

5. Retake search process

A Student may submit one Retake Search Request by selecting countries, subjects, candidate location or radius, and completing checkout.

After checkout, the Student's search is active and locked while eligible School coordinators in the selected countries or search zone review the request. A new search can start after the active request is resolved.

A Retake Search Request does not guarantee placement. No binding commitment from a School exists until a School accepts the request and IBretake records an Accepted Placement.

IBretake may reject, decline, cancel, or refund a Retake Search Request for any lawful reason, including capacity limits, compliance concerns, missing information, suspected fraud, pricing errors, School unavailability, or technical workflow testing.

When a School accepts through the Platform, the School may be required to download, sign, and upload a placement agreement PDF confirming the requested subjects, session, student information, and accepted price. IBretake may require admin review before releasing final coordinator contact details to the Student. If the School does not complete the required signed agreement step within the stated time window, or discards the request, the request may return to the market or move to other eligible coordinators.

After a placement is successfully approved, the Student dashboard may show a success state and the Student may be directed to email for coordinator information and next steps. A successfully approved placement remains locked; the Student may not start another Retake Search Request through the Platform for the same active application flow unless IBretake expressly reopens access.

6. School onboarding and school obligations

Each School using the Platform must provide complete, accurate, and current information requested by IBretake, including its legal name, registered address, email address, telephone number, IB World School code, relevant coordinator details, payment account information, and any company or registry details requested by IBretake.

Each School represents and warrants that:

  • It has the full right, authority, and capacity to offer the services listed on the Platform.
  • Its listings, pricing, dates, deadlines, and subject availability are accurate and not misleading.
  • It is solely responsible for ensuring that it is permitted under applicable IB Policies to host or register the relevant Student.
  • It will honor Accepted Placements except where prevented by law, IB Policies, force majeure, or circumstances reasonably beyond its control.
  • It will promptly notify IBretake of any change affecting availability, deadlines, fees, or the status of an Accepted Placement.
  • Where required by the Platform, it will download, sign, and upload the placement agreement PDF accurately and only after confirming that the School can host the requested subjects, session, and accepted price.

Schools must communicate material changes, cancellations, or compliance issues to IBretake without undue delay. Unless IBretake expressly instructs otherwise, Schools must not bypass the Platform in relation to Retake Search Requests or Accepted Placements sourced through the Platform.

IBretake may request documentary proof from a School at any time and may suspend or remove any School listing where information is incomplete, inaccurate, outdated, or insufficiently verified.

7. Student obligations

Each Student agrees that they will:

  • Provide accurate personal information, contact information, passport or identification details where required, and truthful academic and examination history.
  • Meet all deadlines communicated by IBretake or the relevant School.
  • Review and comply with the relevant School's instructions, code of conduct, venue rules, and exam-day procedures.
  • Arrange and pay for their own travel, accommodation, insurance, visa, and immigration compliance.
  • Independently verify any personal eligibility issue not expressly confirmed in writing by IBretake.
  • Discuss any exam cancellation, timetable conflict, travel plan, visa issue, document requirement, attendance problem, accessibility need, or school-specific instruction directly with the accepting coordinator or School after contact details are released.

A Student must not submit false information, conceal relevant exam history, misuse another person's identity, or submit speculative or abusive Retake Search Requests.

Travel, visas, and off-platform logistics. IBretake does not arrange flights, trains, hotels, accommodation, insurance, visas, border entry, local transport, guardianship, medical arrangements, exam cancellation requests, or attendance logistics. These matters are outside the scope of the Platform and remain the Student's responsibility. If they affect the placement, the Student must discuss them with the accepting coordinator or School; IBretake is not required to act on travel, visa, accommodation, immigration, or other off-platform issues.

8. Fees, payments, taxes, and currency

8.1 Account access

Creating a Student or School coordinator account may be free unless a paid feature is clearly shown. Students pay only when they submit a Retake Search Request through checkout.

8.2 Search package price

The Search Package Price is displayed before checkout. Payment activates the search and allows eligible coordinators in the selected countries or search zone to review the request. The package price is separate from any IB assessment fees, School Fees, travel costs, visa costs, or other third-party costs.

The current development version may include fake, sandbox, test, or demo payment screens. Those screens are for workflow testing only and do not create a real card charge unless a live payment provider and live payment method are clearly presented.

8.3 What the total amount at checkout includes

The total amount payable at checkout may include:

  • The Search Package Price payable to IBretake.
  • Any School Fee payable through the Platform, if this is expressly shown at checkout.
  • Payment processing fees, taxes, currency conversion charges, or other amounts disclosed at checkout.

8.4 Taxes and currency

Unless otherwise stated, all amounts shown on the Platform are exclusive of any local taxes that must legally be added, and currency conversions shown on the Platform are indicative only. Final settlement amounts may vary due to exchange-rate fluctuations, card issuer practices, or payment processor adjustments.

8.5 Payment processing

Live payments, when enabled, are processed through third-party payment service providers such as Stripe. By making a live payment, you agree to the applicable payment provider terms in addition to these Terms.

IBretake may collect the amount from the Student and, where applicable, remit any School Fee to the School after deduction of refunds, chargebacks, processor fees, agreed commissions, or other amounts contractually due.

9. Confirmation, cancellations, and refunds

9.1 No confirmation

If no School accepts a Retake Search Request within 14 days, IBretake starts the full refund process automatically unless a different mandatory legal rule applies or a different period was clearly shown at checkout.

9.2 School cancellation before services are completed

If a School cancels an Accepted Placement before the relevant School services have been completed, IBretake will use reasonable efforts to offer a suitable alternative where appropriate. Any refund of a School Fee is subject to the School's own policies, deadlines, costs already incurred, and applicable law.

9.3 Student cancellation before confirmation

If a Student cancels a Retake Search Request before a School accepts, the refund rules in Section 9.8 apply. IBretake may deduct non-recoverable payment processing costs only where lawful and clearly disclosed.

9.4 Student cancellation after confirmation

If a Student cancels after an Accepted Placement:

  • the Search Package Price is no longer refundable except where mandatory law requires otherwise, because the placement is considered successful once a School accepts;
  • the School Fee is refundable only to the extent that the relevant School agrees to refund it or is legally required to do so;
  • if the School has already incurred registration, administration, exam-related, payment-processing, or other non-recoverable costs, those amounts may be deducted or may remain non-refundable where permitted by law; and
  • if the cancellation occurs after a deadline communicated by IBretake or the School, no refund may be available.

9.5 Failure to provide information or attend

If a Student fails to provide required documents, misses a deadline, fails to appear, refuses to comply with School rules, provides inaccurate or incomplete information, or otherwise causes the placement not to proceed, IBretake may treat the request as canceled by the Student. In that case, the rules in Sections 9.3 and 9.4 apply.

9.6 IBO, School, or external exam authority cancellation

If the International Baccalaureate Organization, a School, a venue, or any other relevant authority cancels, reschedules, or materially changes the examination arrangement, any refund of the School Fee shall be handled in accordance with the refund policy of the relevant School or authority and any applicable law.

9.7 Search Package Price

The Search Package Price is charged for IBretake's search, request routing, coordinator outreach, dashboard, support, payment, refund, and administrative Services. It is refundable according to Section 9.8 and any mandatory law that applies.

9.8 Retake search refund rules

For the Search Package Price, the refund rules are:

  • A Student may request a full refund after 5 working days from submitting a Retake Search Request, as long as no School has accepted the request yet.
  • If no School accepts within 14 days, IBretake starts the full refund process automatically.
  • Once a School accepts, the placement is considered successful and the Search Package Price is no longer refundable except where mandatory law requires otherwise.
  • Refund or withdrawal requests must be submitted in writing to [email protected] with enough information to identify the Account and case number.

If a refund is requested or automatically started before acceptance, IBretake may close, pause, or disable outstanding coordinator review links connected with that search while the refund is processed.

9.9 Placement acceptance

A placement is not guaranteed by payment or by submission of a Retake Search Request. A placement is accepted only when a School accepts the Student's request through the Platform or otherwise confirms acceptance in a way IBretake records on the Platform.

School names may remain private until acceptance. After acceptance, the Student should check email and dashboard updates for confirmation and next steps.

Where the Platform requires a signed agreement and admin review, acceptance alone does not release final contact details. Contact details and next steps are released only after the required signed PDF is uploaded and approved by IBretake admin.

9.10 Sandbox or placeholder payments

Where the Platform clearly displays a sandbox, test, demo, or fake payment screen, that screen is for workflow testing only and does not itself create a real card charge or transfer of funds. Real payment processing will apply only where a live payment provider or live payment method is presented.

9.11 Tutoring and additional services

After placement acceptance, IBretake may offer optional tutoring, revision, advisory, or related services supplied by third parties or partners. IBretake may receive a commission, referral fee, platform fee, or other commercial benefit if a Student purchases those optional services. Such services are separate from School placement unless expressly stated otherwise.

9.12 Chargebacks

A Student must first contact IBretake to seek resolution before initiating a chargeback. If a chargeback is initiated in bad faith or contrary to these Terms, IBretake may recover all resulting losses, fees, reversals, and reasonable collection costs to the extent permitted by law.

9.13 Post-approval coordinator communication

After admin approval of a signed placement agreement, IBretake may send the Student the accepting coordinator's email address, School location, signed agreement link, and relevant retake-search information by email. From that point, the Student and School may need to communicate directly outside the Platform about official IB registration steps, exam-day instructions, arrival times, required documents, cancellation questions, school rules, and local logistics. IBretake is not responsible for decisions, instructions, delays, omissions, or arrangements made directly between the Student and the School outside the Platform.

10. No guarantees

IBretake does not guarantee:

  • That any Student will be accepted by any School.
  • That a requested subject, session, location, or timetable will remain available.
  • That any Accepted Placement will remain unchanged where affected by School decisions, IB Policies, regulatory action, or force majeure.
  • That a Student will receive any specific examination result, diploma outcome, transcript result, university admission outcome, visa approval, or travel clearance.
  • That any travel, visa, accommodation, transport, border, insurance, guardianship, medical, or other off-platform arrangement will be available, successful, refundable, or suitable.

Any content on the Platform is for general informational purposes only and does not constitute legal advice, immigration advice, academic advice, or a guarantee of eligibility.

11. IB policies and third-party decisions

Students and Schools acknowledge that examination availability and registration conditions may depend on third-party decisions and policies outside IBretake's control, including decisions of the IBO, Schools, test venues, local authorities, and payment providers.

IBretake may modify, suspend, or cancel a Retake Search Request or Accepted Placement where reasonably necessary to reflect changes in law, IB Policies, School requirements, safety requirements, sanctions compliance, fraud-prevention needs, or payment risk.

12. Prohibited conduct

Users must not:

  • Create fake accounts or submit false or misleading information.
  • Misrepresent exam history, eligibility, identity, nationality, or documentation.
  • Contact or contract with a School introduced through the Platform in order to avoid Platform charges or Platform rules.
  • Attempt to move any communication, negotiation, or arrangement with another User to any channel outside the Platform, including personal email, WhatsApp, telephone, social media, or any third-party messaging service. All communication between Students and Schools must take place exclusively through the Platform's built-in messaging system unless IBretake expressly allows otherwise.
  • Attempt to circumvent the Platform's content monitoring. All messages sent through the Platform are supervised and subject to automated and manual review to ensure compliance with these Terms and the safety of all Users.
  • Copy, scrape, harvest, spider, crawl, download, or extract School listings, pricing, availability data, or other Platform content by automated means or at scale.
  • Interfere with the operation, security, or integrity of the Platform.
  • Use the Platform for any unlawful, fraudulent, abusive, or unauthorized purpose.

Off-platform communication and enforcement. Any attempt by a Student or School Coordinator to exchange personal contact details, solicit off-platform communication, or arrange any aspect of a Retake Search Request outside the Platform will be treated as a serious breach of these Terms. IBretake may issue a formal warning, apply a temporary suspension, or impose a permanent ban on the relevant account or accounts, including the individual School Coordinator's account independently of the School's account.

Where a Student or School circumvents the Platform in relation to a lead, introduction, Retake Search Request, or Accepted Placement sourced through the Platform, IBretake may charge applicable service charges and any direct losses reasonably suffered by IBretake, without prejudice to any other legal remedies.

13. Intellectual property

All intellectual property rights in the Platform, including its software, databases, design, text, graphics, branding, logos, workflows, and compiled marketplace content, belong to IBretake or its licensors.

Schools grant IBretake a non-exclusive, worldwide, royalty-free license to host, reproduce, display, and use their names, logos, descriptions, fee information, availability information, and related listing content for the purpose of operating, marketing, and improving the Platform.

Users may not copy, reproduce, republish, distribute, reverse engineer, commercially exploit, or create derivative works from the Platform or its content except as expressly permitted in writing by IBretake.

14. Data protection and privacy

IBretake processes personal data in accordance with its Privacy Policy and applicable data protection law.

Users acknowledge that certain personal data may need to be shared between IBretake, the relevant Student, the relevant School, payment providers, professional advisers, and public authorities where reasonably necessary to process a Retake Search Request or Accepted Placement, prevent fraud, comply with legal obligations, resolve disputes, or protect rights and safety.

Users must ensure that any personal data they provide to IBretake is lawfully supplied and does not infringe the rights of any third party.

15. Suspension and termination

IBretake may suspend, restrict, delist, or terminate any Account, listing, Retake Search Request, Accepted Placement, or access to the Platform immediately where:

  • A User breaches these Terms.
  • Required information is missing, false, misleading, or outdated.
  • Fraud, abuse, payment risk, sanctions risk, compliance concerns, or security concerns arise.
  • A School ceases to meet IBretake's onboarding or verification requirements.
  • Continued provision of the Services would create legal, regulatory, reputational, or operational risk.

Termination does not affect any accrued rights, payment obligations, refund rights, or liability claims that arose before termination.

16. Force majeure

IBretake is not liable for failure or delay caused by events beyond its reasonable control, including acts or omissions of Schools, IBO rule changes, changes to exam timetables, school closures, public health emergencies, war, civil unrest, natural disasters, cyberattacks, payment network outages, internet failures, government restrictions, labor disputes, transport disruption, or visa and border restrictions.

Where a force majeure event materially affects a Retake Search Request or Accepted Placement, IBretake may suspend performance, amend the process, offer alternatives, or cancel the affected request or placement.

17. Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation would be unlawful under applicable law.

Subject to the previous sentence, IBretake is not liable for any loss arising from:

  • A School's refusal to accept or continue a Retake Search Request or Accepted Placement.
  • A School's cancellation, overbooking, administrative error, or non-performance.
  • Any change in IB Policies, exam schedules, subject availability, deadlines, or venue arrangements.
  • A Student's ineligibility, inaccurate information, missed deadlines, non-attendance, misconduct, visa refusal, or travel failure.
  • Travel disruption, accommodation problems, visa refusal or delay, border or immigration decisions, missed transport, local transport failure, exam cancellation requests, or any other matter outside the Platform's search and request-routing scope.
  • Any indirect, incidental, special, consequential, punitive, or loss-of-profit damages.

To the maximum extent permitted by law, IBretake's total aggregate liability arising out of or in connection with any Retake Search Request, Accepted Placement, or use of the Platform shall not exceed the Search Package Price actually paid by the Student to IBretake for the relevant request.

18. Consumer rights

If you are a consumer, nothing in these Terms limits any mandatory rights granted to you under applicable consumer protection law.

Where permitted by law, by requesting IBretake to begin processing, matching, communicating with Schools, or otherwise performing the Services before the expiry of any applicable withdrawal period, you expressly request immediate performance of the Services. You acknowledge that, where legally applicable, the right of withdrawal may be reduced, lost, or subject to payment for services already performed.

Any refund or withdrawal request must be submitted in writing to [email protected] together with sufficient information to identify the relevant Account and case number.

19. Complaints and dispute resolution

Any complaint must first be sent to IBretake by email at [email protected] within 30 days of the issue arising or, if later, within 30 days of the User becoming aware of the issue.

IBretake will acknowledge the complaint and aim to provide a substantive response within 14 business days, although more complex matters may require additional time.

Before starting court proceedings, the parties shall attempt in good faith to resolve the dispute through direct negotiation and, where appropriate, mediation.

20. Governing law and jurisdiction

These Terms and any non-contractual obligations arising out of or in connection with them shall be governed by the laws of Poland.

The courts having jurisdiction over the city in which IBretake has its registered office shall have exclusive jurisdiction, except where mandatory consumer law gives a consumer the right to bring proceedings in another court.

21. Changes to the Terms

IBretake may update these Terms from time to time for legal, regulatory, commercial, security, or operational reasons.

If a change is material, IBretake will provide at least 30 days' notice by email, through the Platform, or by another reasonable method. Continued use of the Platform after the effective date of the revised Terms constitutes acceptance of the updated Terms.

22. Miscellaneous

If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

These Terms, together with the Privacy Policy, refund terms, School-specific terms, and any case-specific confirmation, constitute the entire agreement between the parties concerning their subject matter and supersede prior discussions on that subject matter.

No waiver by IBretake of any breach shall be deemed a waiver of any subsequent breach.

A User may not assign or transfer rights or obligations under these Terms without IBretake's prior written consent. IBretake may assign or transfer its rights and obligations to an affiliate or in connection with a merger, restructuring, or sale of business.

Where these Terms are made available in more than one language, the English-language version shall prevail in the event of inconsistency, to the extent permitted by law.
